Don't Slide Back Into Hellhole

Climbing out of a judicial hellhole isn't so easy, it turns out.
In 2006, Madison County's judges - Concerned about the county being labeled one of the top judicial hellholes in the nation by the American Tort Reform Association - enacted reforms that were supposed to level the playing field between plaintiffs and defendants in civil cases and discourage venue shopping.
That year, the number of asbestos cases dropped to 325 after reaching a high of more than 800 a year in the early 2000s. But last year, 814 asbestos cases were filed in Madison County, and this year filings are on a pace for more than 840.
More disturbing than the numbers themselves are the location of the plaintiffs. Al Adomite, vice president of the Illinois Civil Justice League, said the group reviewed about 400 cases from 2009 and found that just 11 percent of the plaintiffs had a connection to Illinois let alone Madison County. He said residents in 47 other states filed cases in Madison County last year.
Madison County isn't a vacation paradise, so the concern is that the county is again becoming a plaintiff's paradise.
